Terms of Use and iOS EULA

1. Eligibility and accounts

• You must be at least 13 years old to use Ember Forge. If you are under the age of majority where you live, you must have a parent or guardian's permission, and they are responsible for your use of paid features.
• Keep your sign-in details secure. You are responsible for activity on your account. Tell us at ruhaan.jain@myemberforge.com if you suspect unauthorized use.
• Give accurate information and keep it up to date. One person may not operate accounts in a way intended to evade a suspension or safety measure.

2. Changes to the App and these Terms

We may update the App, its features, and these Terms from time to time. When we make a material change to these Terms we will update the effective date above and, where required by law, give you notice. Continued use after a change means you accept the updated Terms. If you do not accept them, stop using the App and delete your account.

3. iOS End User License Agreement

• Limited license. We grant you a limited, non-exclusive, non-transferable, revocable license to download, install and use the App on Apple-branded devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms, solely for your personal, non-commercial use. As permitted by those Usage Rules, the App may also be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing. This does not mean that subscriptions or consumable coins are shareable. The App is licensed, not sold.
• Restrictions. You may not copy, modify, reverse engineer, decompile, or create derivative works of the App except as permitted by law; rent, lease, sell, sublicense or distribute it; remove proprietary notices; or use it to build a competing service. Open-source components remain under their own licenses.
• Ownership. We and our licensors retain all rights in the App, the Ember mascot and artwork, and our trademarks. No rights are granted except those stated here.
• Acknowledgement about Apple. These Terms are between you and RU FORGE LLC, not Apple Inc. (“Apple”). RU FORGE LLC, not Apple, is solely responsible for the App and its content, for maintenance and support, and for any claims relating to it.
• Maintenance and support. We are responsible for providing any maintenance and support for the App. Apple has no obligation to furnish any maintenance or support services. See the Support page.
• Warranty. If the App fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App (if any) to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. Any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our responsibility.
• Product claims. RU FORGE LLC, not Apple, is responsible for addressing claims by you or any third party relating to the App or your possession and use of it, including product liability claims, claims that the App fails to meet legal or regulatory requirements, and consumer protection, privacy or similar claims.
• Intellectual property claims. If a third party claims that the App or your use of it infringes its intellectual property rights, RU FORGE LLC, not Apple, is solely responsible for the investigation, defense, settlement and discharge of that claim.
• Legal compliance. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Third-party terms. You must comply with applicable third-party terms when using the App, such as your wireless data service agreement.
• Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of this EULA. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.
• Apple's standard terms. To the extent these Terms are silent, Apple's Licensed Application End User License Agreement applies. If the two conflict, these Terms apply to the extent permitted.

4. Your content and community safety

• You keep ownership of content you submit, such as commitment titles, check-in photos or notes, and messages shared with partners or Pods (“User Content”). You grant us a worldwide, non-exclusive license to host, store, display and transmit it as needed to operate the features you use, and to enforce these Terms.
• You are responsible for your User Content. You promise you have the right to share it and that it will not harm others.
• Not allowed: harassment, hate or threats; sexual content involving minors or any sexually explicit content; content that promotes self-harm or eating disorders; illegal activity; spam or scams; impersonation; content that violates someone's privacy or intellectual property; malware; attempts to bypass safety review or rate limits.
• Safety review. Shared photos and community content may be reviewed by automated tools and by people. We may remove content, limit features, or suspend or end accounts that break these rules or put others at risk, and we may report unlawful content to the appropriate authorities.
• Report and block. If you see content or behavior that concerns you, contact us at ruhaan.jain@myemberforge.com. We aim to act on valid reports promptly. Keep in mind that sharing with a partner or Pod is your choice and you can stop at any time.

5. Focus is a self-blocking tool

Focus uses Apple's Screen Time frameworks to shield apps and websites you choose on your own iPhone. It is designed for self-control: you decide what to block and for how long. It is not a parental-control, monitoring or child-safety product, and it must not be used to restrict or monitor another person's device without their knowledge and consent. Focus depends on iOS and on permissions you grant, and iOS or device settings may allow shields to be changed or removed. We do not guarantee that any app will be blocked at all times.

6. General wellness, not medical advice

Ember Forge, including Ember Fitness & Health+ and any workout, nutrition, wellness, sleep or insights content, is for general wellness and informational purposes only. It is not a medical device and does not provide medical advice, diagnosis or treatment. Talk to a qualified health professional before starting any exercise, nutrition or sleep program, especially if you have a health condition, are pregnant, or take medication. Stop and seek help if you feel unwell. In an emergency, contact your local emergency services. Never ignore professional advice because of something you saw in the App.

7. Optional AI features

Some features, such as AI workout and meal suggestions, motivation and insights, may use artificial intelligence. They are optional and only run on your data after you give consent in the App. You can review or withdraw consent at any time in Profile > AI data sharing. Details are in our Privacy Policy. AI output can be wrong, incomplete or unsuitable for you. It is not professional advice, and you are responsible for deciding whether to act on it. Do not submit information you do not want processed, and do not submit unlawful content.

8. Purchases through Apple

Apple In-App Purchase

Paid features are sold through Apple's In-App Purchase. Purchases are charged to your Apple Account, are subject to Apple's terms, and Apple controls billing, receipts, and payment methods. Prices are shown in the App Store before you confirm and may vary by region and taxes. We do not receive your full payment details.

Ember Fitness & Health+ subscription

• The subscription is an auto-renewing subscription. Its price and billing period are shown on the purchase screen before you subscribe.
• Payment is charged to your Apple Account at confirmation of purchase. The subscription renews automatically unless it is canceled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period at the then-current price.
• Cancel in iPhone Settings: tap your name > Subscriptions > Ember Forge > Cancel Subscription. See Apple's guides: support.apple.com/en-us/118428 and support.apple.com/en-us/118223. After you cancel you keep access until the end of the paid period. Deleting the app or your Ember Forge account does not cancel an Apple subscription.
• Restore. If you reinstall or change device, use Restore Purchases in the App to restore a subscription tied to the same Apple Account.
• Any free trial or introductory offer shown at purchase converts to a paid subscription unless canceled before it ends. Offers shown to you at purchase govern.
• We may change subscription prices or features. Where Apple's rules require your consent to a price increase, Apple will ask you, and the subscription will not continue at the new price unless you agree.

Ignite Coins (virtual coins)

• Ignite Coins are a consumable virtual item with no cash value. They are used only inside Ember Forge, cannot be exchanged for money, transferred between accounts, or redeemed outside the App.
• Coins have no guaranteed lifetime value and we may adjust prices, bonuses and what coins can be used for. If your account is closed for breaking these Terms, unused coins may be forfeited to the extent permitted by law.
• Coins that you have already spent are consumed. Restore Purchases cannot reissue consumed coins.
• The App states that purchased coins are not refundable by us. Refunds for Apple purchases are handled by Apple (see below), and nothing here limits any refund right you have by law.

Refunds

Apple, not Ember Forge, processes payments and decides refund requests. Request a refund at reportaproblem.apple.com. Approval is at Apple's discretion and is not guaranteed. This does not affect any mandatory consumer rights you may have, including statutory withdrawal rights where they apply.

9. Your data, deletion and ending use

You can stop using the App at any time. To delete your account in the App, open Profile > Privacy & Data > Delete account and confirm. You can also email ruhaan.jain@myemberforge.com. Deletion removes your account and current synced fitness and progress records and local caches, but certain records we must keep for legal, security or accounting reasons, backups for a limited time, and community content previously shared with others may remain, as described in the Privacy Policy. Deleting your account does not cancel an Apple subscription or refund purchases. We may suspend or terminate access if you materially break these Terms or to protect users or the service; where practical we will tell you why.

10. Third-party services

The App relies on Apple services (including Screen Time, HealthKit if you choose to import data, and the App Store) and on service providers that help us operate it. We are not responsible for services we do not control, and their terms may apply to you.

11. Disclaimers

To the maximum extent permitted by law, the App and website are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free or secure, that blocking will always work, or that using it will produce any particular result. Some places do not allow certain disclaimers, so some of the above may not apply to you.

12. Limitation of liability

To the maximum extent permitted by law, RU FORGE LLC and its members, officers, employees and licensors will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising out of your use of the App. Our total liability for any claim relating to the App is limited to the greater of the amount you paid for the App or subscription in the 12 months before the claim or US $50. Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including for death or personal injury caused by negligence, for fraud, or for any mandatory consumer right.

13. Consumer rights

If you are a consumer, you may have legal rights that these Terms cannot waive, depending on where you live. These Terms are intended to be read subject to those rights. If a provision is not enforceable against you, the rest still applies.

14. Governing law and disputes

These Terms are governed by the laws of the Commonwealth of Massachusetts and applicable U.S. federal law, without regard to conflict-of-law rules, and subject to any mandatory consumer protection laws of the place where you live. Subject to those mandatory rights, the state and federal courts located in Massachusetts have jurisdiction over disputes, and you and we consent to that jurisdiction. Please contact us first at ruhaan.jain@myemberforge.com so we can try to resolve the issue informally.

15. General

These Terms are the entire agreement between you and us about the App and replace earlier agreements on the subject. If we do not enforce a provision, that is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger or sale. Sections that by their nature should survive termination will survive.
